1. Definitions & Interpretation
1.1 “Customer” means a person who has contacted us through any means to find out more about any goods or services we provide , or may/ has / entered into a contract with us for the supply of any goods or services by us.
1.2 When you purchase something from our store, as part of the buying and selling process, some examples of personal data which we may collect from you include name, residential address, email address & contact number.
2. Intellectual Property Rights
In consideration of your use of BH Aircon Solutions website and application, you acknowledge and agree to the following terms and conditions:
2.1. We hereby grant you a limited and revocable licence to access and use our website and application on any mobile device that you own or control, subject to your compliance with these terms and conditions. However, we retain all rights, title, and interest in and to the website and application, and you have no ownership or other rights in them.
2.2. We own the intellectual property rights in BH Aircon Solutions, including its technology and support. You acknowledge that you are granted no rights in or to BH Aircon Solutions other than the right to use it in accordance with these terms and conditions. If you breach these terms of use, your right to use BH Aircon Solutions will be terminated immediately.
2.3 The use of any part of the content on BH Aircon Solutions for commercial purposes is strictly prohibited unless you obtain a licence or written consent from us.
3. Changes to This Privacy Policy
We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon posting on the website. If we make material changes to this policy, this page will be updated promptly so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it. If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.
4. Quotation & Fees
4.1 Validity of Quotation is fourteen (14) days from date of issue, or until we withdraw the offer before your acceptance. Prices and/or terms may change if your order is placed at a later date. You may be asked to provide payments upfront.
4.2 Upon completion of work, a job sheet will be filled out by the supervisor who has attended the site which will be then furnished to you or the person in charge on site or an authorized person with an obligation to sign and date the job sheet, thereby signifying your agreement that you are satisfied with the undertaken works and time on site as true. Please check the goods and services carefully. Upon your signing and dating the job sheet, signifying that the goods and services are satisfactory, your rights to raise any issues in relation to the same are waived in their entirety. For the avoidance of doubt, where we are engaged to provide installation services, we do not provide any warranty relating to any aspects of the quality and/or fitness of use of the products installed. These are subject to warranties issued directly to you from the relevant manufacturer or seller of the products.
4.3 The acceptance of a Quotation by you constitutes an acceptance by you to purchase the goods and/or services specified in it on these Terms of Trade and you are deemed to be liable to pay for all such goods and/or services; and to perform your obligations hereunder in a full and timely manner.
4.4 Additional costs may be incurred if:-
a. Variations or additions not stated before commencing of works which we find to be necessary and which could not have been identified when the original Quotation or survey was given;
b. Our engineers have to remove any material which could not have been reasonably foreseen when the original Quotation was given and we became aware of the same only when installation/service commences; and/or
c. For any reason we cannot gain access to the site, resulting in delays; or
d. You effect a cancellation less than twenty-four (24) hours before the original scheduled time.
4.5 If an Installation takes place and is semi or fully installed but you change your mind about specifications and/or systems, please note that we have a no returns policy on all products and you will be re-charged for a re-quotation of different specification or systems. The original quoted cost for labour may vary according to the new specifications. You will be liable to pay in full the original agreed amount of a fully installed, tested and commissioned system despite a change of mind. You will also be liable to pay an amount invoiced by us if a system is semi installed. Invoice/s will be worked out accordingly. Additional charges will also apply to installations where works are delayed as a result of an error on your part.
5. Liability
5.1 We will not accept liability for delays outside our control, including fire; war; pandemics; or adverse weather/traffic conditions. If any of these situations should arise, we will advise you of an alternative service/fitting date.
5.2 All maintenance contracts should be signed by both Parties. Any evidence of another contractor having performed works on any asset(s) covered under our maintenance contracts shall automatically make any warranty to you our maintenance contracts void. No compensation of remaining service shall be expected by us. Cancellations of maintenance contracts should be made to us in writing.
6. Indemnification
6.1 By accessing or using the services provided by BH Aircon Solutions Pte Ltd, you agree to indemnify BH Aircon Solutions Pte Ltd, its directors and employees from any and all claims, liabilities, damages, losses, and expenses (including legal and accounting fees) that may arise in connection with:
a. Your violation of our Terms of Use;
b. Your violation of any laws or regulations in relation to the use of the services;
c. Any interaction you have with our staff, including but not limited to any injury, losses or damages (whether direct, incidental, consequential or otherwise) that may occur during or as a result of such interaction; or
d. Your violation of any third party rights.
6.2 You agree to cooperate fully in the defence of any such claims, and we reserve the right to assume exclusive control and defence of any matter subject to indemnification by you. You agree not to settle any such matter without obtaining our prior written consent.
7. Payment
7.1 Payment for the services rendered shall be due and payable within three (3) days of completion of the service. Failure to remit payment within the specified time frame may result in late fees, interest charges, and/or suspension of services until payment is received in full.
7.2 In the event of non-payment of dues, the service provider reserves the right to pursue legal action to recover any outstanding amount in accordance with the laws of the Republic of Singapore. The party responsible for the unpaid dues will be held liable for all costs and expenses incurred in connection with such legal action, including but not limited to attorney’s fees, court costs, and any other related expenses.
7.3 If any payment remains outstanding for more than three (3) days, the service provider reserves the right to suspend any scheduled cleaning services until payment is made in full. The service provider may, at their discretion, terminate the agreement if the outstanding payment remains unpaid beyond the specified period.
8. Installation
8.1 Any other products or services, to remain the property of the company until payment is made in full. This ensures that the company retains ownership and control of the systems until all financial obligations are fulfilled.
8.2 It is important to ensure that any obstructions, such as televisions, furniture, and computers, are moved prior to the installation of an air conditioning unit. If this is not possible, the engineers will do their best to move the items obstructing access. However, it is important to note that neither the engineers nor the company will accept liability for any damage that may occur during this process.
8.3 Additionally, it is agreed that major debris and particles caused by drilling and construction work will be removed after the installation. However, it is not standard practice to provide a deep cleaning service, such as sweeping and mopping of floors, after an installation.
9. Specific list of items that are excluded in the installation:
a. MCST or Town Council/Landlord consents or fees;
b. Any making good or redecoration after installation has completed;
c. Any lifting/access equipment not initially planned for;
d. Any carpentry or building works of any kind;
e. Diamond drilling;
f. Provision of electrical supply & mains connection (unless specifically quoted for);
g. Electrical Certification;
h. Penetrations to building exterior;
i. Fitting of exterior louvres and attenuated panels
j. Any out of hours works;
k.Providing Crane services; and
l.Any item not specified in previous communications and the Quotation.
10. Exchanges and Refunds
10.1 All our goods sold are non-exchangeable and non-refundable.
